Schmidt planning to appeal dismissal of murder charge against Silver Creek woman...
The Chautauqua County District Attorney's Office is appealing the recent dismissal of a second-degree murder charge against a Silver Creek woman who is accused of allowing her child to die from untreated diabetes. District Attorney Jason Schmidt says he pursued the count against 37-year-old Ashley Bertino after an investigation into the April 2024 death of 12-year-old Mya Smith. County Court Judge David Foley dismissed the charge in the spring, which Schmidt anticipated might happen, and, they've been already working on an appeal... and, that they would take it to the State Appellate Court.
